North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish each of his employees conditions of employment
and a place of employment free
from recognized hazards that were causing or likely to cause death or
serious physical harm to employees in
that employees were exposed to hazards from live electrical wires and
ungrounded appliances.
a) Employer failed to provide temporary migrant housing which was free
from recognized hazards in
that electrical hazards were present as follows.
1) Occupants were exposed to live electrical wires in the trailer located
at 406B Wingfield rd. in that
one wall outlet was missing a cover plate.
2) Occupants were exposed to electrical hazards in the trailer located at
406C Wingfield rd. in that:
(i) One wall outlet was missing cover plate, exposing occupants to live
electrical wires.
(ii) Two Ceiling light fixtures were hanging down over bathroom sink,
within arm's reach,
exposing live wires.
(iii) The path to ground from the kitchen refrigerator was not permanent
and continuous. The
refrigerator was not grounded.
3) Occupants were exposed to electrical hazards in the trailer located at
2010 Tootsie Lane in that:
(i) Two ceiling light fixtures and a wall fixture had exposed, live
electrical wires.
(ii) One home-made light fixture was tied to a board on the wall, creating
an electrical fire hazard.
(iii) Several light switch and receptacle boxes were loose and hanging
away from the wall, exposing
occupants to the potential for exposure to live wires.
Among others, one feasible and acceptable means of abating these
violations is to properly ground refrigerator
and install all electrical fixtures in accordance with local building
codes, the National Electric Code and any
other applicable standards and or codes.
