North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:
The employer did not furnish each of his employees conditions of
employment and a place of
employment free from recognized hazards that were causing or likely to
cause death or serious physical
harm to employees in that employees were exposed to elevation on a locally
designed personnel platform
without appropriate designed safety features:
a)new construction site - the employer had provided a metal framed
platform with only three
metal rail sides for a completed measurement of 15-feet wide and 3-feet,
4-inches deep
and 41 inches tall leaving an open front with no toe board.  The platform
was not secured
to the backrest of a MasterCraft, Model MC5675.01, forklift which
exhibited a decal
stating that the forklift was not designed to lift or lower personnel.
Abatement note: Among other methods, one feasible and acceptable abatement
method to correct this
hazard is to use appropriately designed personnel lifting equipment such
as
scissors-lift type vehicles or
bucket trucks.

complies with the design
requirements in para. 7.35.3."; Paragraph 4.17.3(b); "the platform
attachments means are applied and the
platform is securely attached to the lifting carriage or forks."e
