North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards: a)establishment, manual line 1 area - where employees were allowed to work in close proximity of a support beam that had been struck by a forklift disconnecting its base from the floor. (Reference: North Carolina Fire Code, 2002 Edition, North Carolina Building Code Council and North Carolina Department of Insurance, Post Office Box 26387, Raleigh, North Carolina 2761, Chapter 1, section 110, Unsafe conditions - Structures or existing equipment that are or hereafter become unsafe or deficient because of inadequate means of egress or which constitute a fire hazard, or are otherwise dangerous to human life or the public welfare, or which involve illegal or improper occupancy or inadequate maintenance, shall be deemed an unsafe condition.),
