North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)drip pad - where employees were allowed to use a hook-type underhung 1/2 ton hoist that was used to lift a section of walking platform (approximately 100 lbs) that was missing its hook latch. The hoist was not inspected in the past 12 months. One feasible and acceptable abatement method, among others, to correct this hazard is to conduct inspections of the hoist. b)drip pad - where employees were allowed to use a hook-type underhung 1/2 ton hoist that was used to lift a section of walking platform (approximately 100 lbs) where a steel beam was not load rated to determine its load capacity. One feasible and acceptable abatement method, among others, to correct this hazard is to determine load rating of the support beams and label the beam with the load rating. References: Reference ANSI B30.16-1981, Section 16-2.1.3: Periodic Inspection, Complete inspections of the hoist shall be performed at intervals as defined in 16-2.1.1(b)(2) & Reference ANSI B30.16-1981, Section 16-2.2.2: Load Test shall be performed as outlined in 16-2.2.2
