North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)shop - where employees were allowed to use a 2 ton electric chain hoist to lift miscellaneous metal parts for the plasma cutter table, the safety latch was missing on the hook and the rail was not load rated. The hoist had not been inspected in the past 12 months. Ref: ASME B30.16-1981, Section 16-2.1(b)(2); Table 2 One feasible and acceptable means of abatement, among others, to correct this hazard would be to conduct inspections of the hoist, chain, hook, as specified in ASME B30.16-1981.
