North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to thrown against/struck by/crushed by Roll Over Protective System (ROPS) during tipover: a)facility - where the operator of the DAEWOO G20-E3, S/N CX-01828, 4,000 pound capacity forklift was not wearing the seat belt during operation. Abatement note: Among other methods, one feasible and acceptable abatement method to correct this hazard is to have operators fasten the seat belt when operating equipment. Reference: ASME B56-1-1993, Paragraph 5.3.19: An active operator protection device or system, when provided, shall be used.
