North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish to each of his employees  conditions of
employment and a place of employment free
from recognized hazards that were causing or likely to cause death or
serious physical harm to employees, in
that employees were exposed to fall hazards while riding in the personnel
platform without any type of fall
protection system.
a)new multi-family construction - where the operator of the TEREX TH644C,
S/N 046014 rough
terrain forklift elevated two employees of Keith Oxendine DBA Keith
Oxendine,
in an 8-foot
wide, 4 foot deep, 4-foot tall, wooden platform without a guardrail or any
type of fall protection
system in use.
Abatement note: Among other methods, two feasible and acceptable abatement
methods to correct this hazard
is to install guardrails or have employees wear appropriate fall
protection systems.
Reference: ASME B56-6-1992, Paragraph 5.15.1(k); " Be certain that
required restraining means such as
railings, chains, cable, body belt(s) with lanyard(s), etc., are in place
and properly used." and Paragraph
8.25.1;  "Design requirements for the manufacture of the platform shall
include the following: (l) restraining
means such as a guardrail or a means for securing personnel such as a body
belt and lanyard.l
