North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to electrical hazards from exposed live wires, ungrounded appliances, and improper use of temporary wiring: a) Employer failed to provide migrant farm workers with a temporary labor camp site that was free from electrical hazards: 1) Circuit breaker box, in first bathroom of white house, located beside bathroom shower above bathroom toilet. 2) Light fixture, in second bathroom of white house, located above/beside shower stall had no cover. 3) Ceiling light fixture in white house, not mounted correctly exposed wire. 4) Wall outlets and light switches throughout white house, had no face plates exposed wire. 5) Light bulbs missing in outlets throughout white house and white trailer, exposing live parts. 6) Temporary wiring was used in lieu of permanent wiring throughout white house. 7) Flexible cords were run through doorways throughout white house. 8) The path to ground from the refrigerator in the kitchen was not permanent and continuous in that the plug was not plugged into a GFCI outlet directly. It had been plugged into a drop cord in white house. 9) Light switch cover broken, in white trailer, exposed wires. Among others, one feasible and acceptable method of abating these violations is to remove all temporary wiring and provide housing for migrant workers with permanent wiring that meets local building codes, the National Electric Code and any other applicable standards and or codes.
