North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to being stuck by debris from the demolition of a building due to the removal of the protective grid/glass in front of the operator. Re: fig 8.2, pg 8-1 book number SK3004KMMC2- R2, Operators Manual for MARK IV Hydraulic Excavator SK300: a) 1 East Lenoir St.-an employee of the sub contractor, operating a Kobelco MARK IV SK300 hydraulic excavator, was exposed to being struck by demolition debris due to the absence of a protective guard as required by para C fig 8.2 pg 8-1 of the operator's manual. One feasible means of abatement is to obtain and install the proper guard from the manufacturer or to obtain information on local manufacture of the guard from Mr. Reese Norwood, 706-624-2875
