Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
Employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that:
a)  On or about July 9, 2005 employees, tilting up 14'x15' (approximate
dimension) perimeter
exterior third floor 2"x6" sheeted stud wall sections with a manually
lever operated hoist (come-
along) between the hoist anchorage and exterior floor edge, were exposed
to the hazards of being
struck by the stud wall anchorage support load, falls and/or being struck
by sheeted stud wall
being lifted, due to tension against wedged wall being lifted and the
floor framing, wall weight,
failure of the hoist anchorage and collapse of the studwalls.
Among other methods one feasible and acceptable method to correct this
hazard is to follow
ASME B30.21-1999 Manually Lever Operated Hoists, including, but not
limited to;
Section 21-2.6.2(a): The Supporting structure or anchoring means shall
have a load rating equal
to that of the hoist,
Section 21-2.6.2(d): Hoists shall be used only in locations that will
allow the operator to be free
of the load,
Section 21-2.6.3(l): The operator shall not apply a load to the hoist
until the operator and all
other personnel are clear of the load, and
Section 21-2.6.3(m) The operators shall make sure a load clears obstacles
before moving.
