Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
Employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that:
a)  On or about October 12, 2005 an employee observed securing an external
residential window
from a stacked load of drywall placed on the forks of a KM 461 universal
fork attachment to
the vehicle mounted extensible and articulating boom was exposed to the
hazards of falls in
excess of 12' and/or being struck by the lifting device being used for
transport and as an
unprotected work platform due to falling and/or system failure.
Among other methods one feasible and acceptable method to correct this
hazard would be to
follow the KM 461"Kinshofer Lift All" Operators Manual, General
Information an Operative
Conditions section which prohibit using the KM 461 for the transport of
employees.
