Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to overloaded or unstable material handling equipment: Waldo County Vocational School - On or about October 28, 2005, a New Holland L565 skid steer was loaded with 25 panels of drywall weighing approximately 1,730 pounds. The maximum capacity of the skid steer was 1,500 pounds. Among other methods, one feasible and acceptable means of abatement would be to reduce the load by transporting fewer drywall panels per trip.
