Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were operating the fork truck without wearing the seat belt provided by the manufacturer: a.) D Bay - employee was not wearing the seat belt that was provided by the manufacturer on the Daewoo GC 18S fork truck and was operating the vehicle on damaged concrete.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by the counter-weight of the hydraulic wheel- mounted crane: a.) Scrap Sorting Yard - employee(s) working in the scrap yard while the hydraulic wheel- mounted crane was in operation were exposed to a crushing hazard. The swing radius was not guarded, barricaded or demarcated. ABATEMENT NOTE: Among other methods, feasible and acceptable means to correct the condition include erecting a physical barricade to prohibit entry into the danger zone as referenced by OSHA Construction standard 1926.550 and ANSI standards B30.5 1994 and B30.20 2006. 30 CFR 1926.550(a)(9) states "Accessible areas within the swing radius of the rear of the rotating superstructure of the crane shall be barricaded in such a manner as to prevent an employee from being struck or crushed by the crane." ANSI stnd. B30.5a 1994 section 5-3.2.1.4a states "The person directing the lift shall see that: all persons are clear of the swing radius of the crane counterweight." ANSI stnd. B30.20 2006 section 20-5.4.4(f) states "Do not allow load or grapple to come into contact with any obstruction."."
