Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to fall hazards:
(a)Blast Area: On or about October 27, 2005 the employer allowed the use
of the
bucket on the John Deer 310 E backhoe to raise and lower an employee in
order
to sandblast buoys. The employee was not protected from a fall hazard of
approximately 8 feet while standing in the bucket.
Among other methods, one feasible and acceptable method to correct this
hazard is to provide
a scaffolding or other approved personnel platform to accomplish this task
as well as follow the
manufacturers recommendations to only allow the operator on the machine
and to prohibit
employees from standing in the bucket of the backhoe.
