Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: (a)On August 16, 2006, an employee of TRS Metal & Roofing, LLC operated a Genie Z60/34 aerial lift without training for that specific lift. The employee operated the lift in a manner which blocked the view of the direction of travel at the lift's maximum speed. This exposed employees to struck-by and collision hazards. Among other methods, a feasible and acceptable method to correct this hazard is to follow the American National Standards Institute (ANSI), A92.5-1992; for Boom-Supported Elevating Work Platforms; Section 7.11.13 Travel Speed; Section 8.5 Training and the Genie Operators Manual for Z-60/34 lifts - Training and operating requirements. Certification, and documentation/evidence of abatement is required. Certification of abatement is required by 29 CFR Part 1903 and is to be submitted within ten (10) calendar days after the abatement date.ment
