Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees not utilizing seat belts were exposed to caught-in-between and fall hazards while operating a concrete breaker equipped with roll over protection (ROPS). (a)Employees were exposed to caught-in-between injuries while operating the Arrow Master hydraulic concrete breaker (Model 1350 and Serial Number 6087), and the employer did not ensure that the seat belt supplied on the machine was used. Among other methods of abatement, one feasible and acceptable method to correct this hazard is to prohibit employees from operating this type of equipment without wearing a seat belt as required by the operator's manual. No certification required. Violation Abated.on
