Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to THE HAZARD OF BEING STRUCK-BY: a) On or about 11/3/05 in the Receiving Area: The overhead Load Lifter 1 1/2 ton hoist had a damaged safety latch. Among other methods, feasible and acceptable abatement methods to correct to the hazard are to: 1. Install new safety latch on the lifting hooks in accordance with ANSI B30.16- 1993, Section 16-1.2.9. b) On or about 11/3/05 in the Receiving Area: The supporting rail for the overhead Load Lifter 1 1/2 ton hoist had no load rating or capacity markings on it. Among other methods, feasible and acceptable abatement methods to correct to the hazard are to: 1. Prior to installation and use, ensure the supporting structure is designed to withstand the loads and forces imposed by the hoist for the rated load in accordance with ANSI B30.11-1980, Section 11-2.2.2. 2. Mark the rated load on the rail in accordance with ANSI B30.11-1980, Section 11-1.1. Abatement documentation must be submitted for this item.
