Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by falling roof structure. a)On or about 1/10/06, Middle Room Roof: The wooden roof structure was severely deteriorated, rotted and broken in numerous locations throughout the roof structure. There were up to four adjacent structural support members (rafters) that had failed. Also, support columns were not plumb, support beams had failed, and roof sheathing had failed. The roof structures capacity does not meet the minimum requirements of the New York State Building Code. b)On or about 1/10/06, Back Room Roof: The wooden roof structure was severely deteriorated, rotted and broken in numerous locations throughout the roof structure. There were up to four adjacent structural support members (purlins) that had failed. The roof structures capacity does not meet the minimum requirements of the New York State Building Code. Among other feasible abatement methods that could be used: 1) Rebuild the roof utilizing all the requirements of the New York State Building Code. 2) Utilize a Structural Engineer to determine what repairs could be made to the existing roof structure, and make the repairs. Abatement documentation must be submitted for this item.
