Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck-by the load should the load slip off the load hook or if the hoist malfunctions: a)Throughout the facility, on or about 1/26/06: The following hoists were not being inspected on a frequent and periodic basis: 1)3-Ton CM Hoist, #6, safety clip was broken. 2)1/4-Ton Budgit Hoist, safety clip was broken. 3)1/2-ton Demag Hoist, pendant controls were not labeled. Among other methods, one feasible method of abatement is to replace the safety clips on the load hook, label all pendant controls and conduct frequent and periodic inspections of the hoists for wear, deterioration and malfunction as per ASME B30.16-1993.
