Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to THE HAZARD OF BEING STRUCK-BY THE LOAD:
a)Truck Bay Area, on or about 2/2/07:  5-ton Jet chain hoist had the
following
deficiencies:
1)The hook was not equipped with a safety latch;
2)The hoist had not been inspected on a frequent and periodic basis;
3)The hoist was not legibly marked with the manufacturer's name and
load rating.
Among other methods, one feasible method of abatement is to:
1)Inspect the hoist on a frequent and periodic basis for wear,
deterioration and malfunction as per ASME B30.16-1993, Section 16-
2.1.
2)Install a new safety latch to the hook as per ASME B30.16-1993,
Section 16-1.2.9 Hooks.
3)Clean the hoist so that the manufacturer and load capacity is legible
as per ASME B30.16-1993, Section 16-1.1 Marking.
Abatement certification must be submitted for these items.
