Nevada Revised Statute 618.375(1): The employer did not furnish employment and a
place of employment which was free from recognized hazards that were causing or
likely to cause death or serious physical harm to employees: The employer faile
d to ensure fall protection was used as follows: (a)On the West side of the Cent
ennial/ Simmons construction Project, Two employees were riding and doing framin
g work inside a Snorkel Aerial Lift, serial #JU00057, approximatelty 20 feet hig
h, and was not wearing fall protection as required. Reference: ANSI A92.5 - 1992
Boom-Supported Elevating Work Platforms: Section 7.3.3 Pre-Start Inspection: Be
fore use each day or at the beginning of each shift, the aerial platform shall b
e given a visual inspection and functional test including but not limited to the
following: (c) Personal protection devices, including fall protection.
Section 8.8 During Operation: The aerial platform shall be used in accordance wi
th this standard. The operator shall ensure the following before each elevation
of the platform: (g) Ensure all personnel in the platform are wearing fall prote
ction devices and other safety gear as required at all times. One feasible means
of abatement is to make sure that the proper personnel fall protection equipmen
t required to do the job is provided and utilized.
