Nevada Revised Statute 618.375(1): The employer failed to furnish employment and a place of employment which was free from recognized hazards that were causing or were likely to cause death or serious physical harm to his employees: The employer failed to ensure that Power Take-Off (PTO) drive shaft was guarded, as follows: a.Wynn Las Vegas, Golf Course Maintenance, Kubota Tractor with a Fertilizer Spreader H/L 1250/L 1500, the PTO drive shaft of the fertilizer spreader was not guarded/shielded exposing employees to serious physical harm while making adjustments or cleaning. Reference: Lely Industries, Operator's Manual, Fertiliser Spreader H/L 1250/L 1500, Safety Instructions - "Make sure that all safety guards and protection devices are in place. Keep out of reach of moving parts. Stop engine, PTO and moving parts before adjusting, cleaning or lubricating the machine". One acceptable method of abatement is to follow all prevailing safety regulations, including those in the Operator"s Manual for spreader and tractor.
