Nevada Revised Statute 618.375(1):  The employer failed to furnish and a
place of employment
which were free from recognized hazards that were causing or likely to
cause death or serious
physical harm to employees in that employees were exposed to:
The employer failed to ensure that a scissor lift was safely used:
a. At the District Phase II, building "A", a foreman inside a scissor lift
climbed onto a
wood platform secured to the top rail of the scissor lift in order to
reach the beam he was
working on.  When he transitioned from the floor of the scissor lift onto
the wood platform, he
was not tied off and was exposed to a fall of approximately 29 ft.
Reference: ANSI A92.6-1979 14.2.6 Personnel shall maintain a firm footing
on the platform
while working thereon unless they are secured by safety harness/lanyard
devices fixed to
manufacturer-approved hard points. Use of railings or planks, ladders or
any other device on
the work platform not conforming to 14.3.3. for achieving additional
height
shall be prohibited.
b. At the District Phase II, building "A", a foreman was standing on a
wood platform
secured to the top rail of the scissor lift.  The modification or
alteration to the scissor lift had
not been certified in writing by the manufacturer or any other equivalent
entity.
Reference: ANSI A92.6-1979 l4.3.3. Modifications or Alteration. All
modifications and
alterations to work platforms shall be certified in writing by the
manufacturer or by any other
equivalent entity, such as a nationally recognized testing laboratory, as
being in conformance
with all applicable provision of this standard, and as not impairing the
safety of the equipment.
One feasible means of abatement would be to provide the employee with a
scissor lift capable
of reaching the work station.
