North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being crushed by the automobiles on the hydraulic automotive lifts: a)Bay 2 - located on the right side of the automotive area: the hydraulic automotive lift was observed to have a locking mechanism which was not operational. b)Bay 3 - located on the right side of the automotive area: the hydraulic automotive lift was observed to have a locking mechanism which was not operational. c)Bay 5 - the first bay located on the left side of the automotive area: the hydraulic automotive lift was observed to have a locking mechanism which was not operational. d)Bay 6 - the second bay located on the left side of the automotive area: the hydraulic automotive lift was observed to have a locking mechanism which was not operational: REF: ANSI Standard B153.1-1981. Section 3.2 Hydraulic Lifts Only: Subsection 3.2.1. Locking Device. Automotive lifts with travel in excess of 36 inches shall be equipped with an automatic mechanical device to hold the lift in the fully extended position. The devices shall have a safety factor of not less that 3 based on the rated load capacity. One acceptable and feasible means of abatement is to institute a regular inspection and maintenance to prevent future problems with the locking mechanisms on the hydraulic lifts.
