Section 5(A)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish to each of his employees employment and a
place of employment which were free from
recognized hazards that were causing or were likely to cause death or
serious physical harm to employees in that
employees were exposed to a struck by hazard:
On or about 2/2/2006, at NW 34th Street, near N Miami Avenue,  employees
were not wearing high visibility clothing
while walking and working in the travel lanes of a roadway.
Among other methods of abatement, a feasible and acceptable method to
correct this hazard is to enforce the use of high
visibility vests.
In the Alternative:
29 CFR 1926.95(a): Personal protective equipment, including personal
protective equipment for eyes, face, head, and
extremities, protective clothing, respiratory devices, and protective
shields and barriers, was not provided, used, or
maintained in a sanitary and reliable condition, wherever it was necessary
by reason of hazards of process or
environment, chemical hazards, radiological hazards, or mechanical
irritants encountered in a manner capable of causing
injury or impairment in the function of any part of the body through
absorption,
inhalation, or physical contact:
On or about 02/2/2006, at NW 34 Street, near N Miami Avenue, employees
were not wearing a high visibility clothing
while walking and working in travel lanes of a roadway.
