Section 5(a)1 of the Occupational Safety and Health Act of 1970:
The employer did not furnish to each of his employees employment and a
place of employment
which were free from recognized hazards that were causing or likely to
cause death or serious
physical harm to employees in that employees were exposed to the hazard of
being struck by
overturning equipment.
On or about 4/27/06, an employee near the CNC Lathe machine was exposed to
being struck
by an overturning forklift while operating it because the employer did not
require the use of an
operator restraint device.
Among other methods, one feasible abatement method to correct the hazard
is to require the use
of seatbelts as recommended in ASME B56.1-1993: Safety Standard for Low
Lift and High Lift
Trucks.
PLEASE NOTE:  CERTIFICATION OF ABATEMENT IS NOT REQUIRED FOR THIS
VIOLATION.
