Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazard: On or about 05/03/06, at or near the intersection of Gardenia Drive and N. Military Trail in Palm Beach Gardens, Florida, employees were exposed to the hazard of being struck by motor vehicles while working on the eastbound lanes of Gardenia Drive because they were not wearing high visibility vests while exposed to moving vehicular traffic. Among other methods of abatement, one feasible and acceptable method to correct this hazard is to provide high visibility vests to employees working on a road as referenced in the Manual on Uniform Traffic Control Devices (MUTCD). IN THE ALTERNATIVE 29 CFR 132(a): Protective equipment was not used when necessary whenever hazards capable of injury and impairment were encountered: On or about 05/03/06, at the intersection of Gardenia Drive and N. military Trail in Palm Beach Gardens, Florida, employees were exposed to a struck by hazard due to the lack of high visibility vests. PLEASE NOTE: DOCUMENTATION AND CERTIFICATION OF ABATEMENT IS REQUIRED FOR THIS VIOLATION.
