Section 5(a)1 of the Occupational Safety and Health Act of 1970:
The employer did not furnish to each of his employees employment and a
place of employment
which were free from recognized hazards that were causing or likely to
cause death or serious
physical harm to employees in that employees were exposed to a
struck-by/crushing hazard from
suspended loads:
a) On or about 06/08/06, on the northeastern side of the site, an employee
was exposed to the
hazard of being struck-by a load of rebar that was suspended over the
employee.
b) On or about 06/08/06, on the 19th floor, on the west side of the
building, two employees
were exposed to a struck-by hazard by a concrete bucket that was being
lifted into position over
the employees.
c) On or about 06/16/06, on the northeastern side of the site, an employee
was exposed to the
hazard of being struck-by/crushed by a load (generator) that was being
lifted directly overhead
the employee to the 19th floor.
Among other methods of abatement, one feasible and acceptable method to
correct this hazard
is for the exposing employer to prohibit employees/workers from walking
under suspended
loads.
