Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to the employees in that employees were exposed to: An employee was exposed to a fall hazard when working approximately 9ft. high on a field fabricated aluminum plank secured by a small nylon strap attached to a rough terrain forklift. This condition did not meet the design and use requirements of ASME B56.6 Section 5.15.1 (a) in the following areas: 1) On the forks of the rough terrain lift the company did not have the employee on a personnel platform that complied with the design requirements listed in Part III of the ASME B56.6-2002 Standard. Among other methods a feasible and acceptable means of abatement of these hazards are to use a safer alternate method such as the use of a platform approved by the manufacture meeting the requirements of ASME B56.6-2002 for the attachments on rough terrain lifts.n
