Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to the employees in that employees were exposed to: On February 23, 2006, two employees were observed exposed to a fall hazard while working approximately 13 feet high on a field fabricated, wooden platform positioned on the forks of a rough terrain forklift. This condition did not meet the design and use requirements of ASME B56.6, Section 5.15.1(a). Among other methods, a feasible and acceptable means of abatement of this hazard is to use a safer, alternative method of hoisting personnel such as the use of a platform approved by the manufacturer and meeting the requirements of ASME B56.6-2002 for attachments on rough terrain lifts.n
