A.R.S. 23-403.A.: The employer did not furnish to each employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees in that the employer did not ensure that restraining devices ( i.e., seat belts) were installed on a forklift to restrain the operator in the event of a rollover as recommended in the American National Standards Institute: (a) 9380 West Northern Avenue, Glendale, AZ. 85301: An employee was operating a LULL Highlander rough terrain telescoping boom forklift model number 844TT-34, serial number 0477WTN which was not equipped with a seat belt to restrain the operator(s) in the event of a rollover.s)
