Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were likely to cause death or serious physical harm to employees in that: a) Sports Arena, Inc. dba Toledo Sports Arena worksite, One Main Street, Toledo, Ohio: On or about January 27, 2006, during outdoor light replacement activities, the employer did not ensure that the platform on the forks of the Yale forklift, serial number E177B10883T, was secured to the forks of the forklift, employees used appropriate fall protection system/devices, the moving parts on the mast were guarded, or that the area around the forklift was coned off during the work. Abatement Note: One feasible abatement would be to follow the precepts of ASME B 56.1, Safety Standard for High Lift and Low Lift Trucks, 2004 edition, which requires that platforms be secured to the forks of the forklift, that fall protection systems be used on the front of the platform, that moving parts on the mast be guarded and that the area around the forklift be coned off during the work. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
