Section 5(a)(1) of the Occupational Safety and Health Act of
1970:  The employer did not furnish employment and a place of
employment which were free from recognized hazards that were
causing or likely to cause death or serious physical harm to
employees in that employees were exposed to: a fall hazard from
using the bucket of an end loader as a personnel carrier:
(a)  IRL Inc. dba Integrated Resources, 4950 Stickney Ave.,
Toledo, Ohio:  On or about the week of January 23, 2006, the
employer used the bucket of the Kawasaki 90Z IV end loader to
raise and lower an employee up to and down from the south
ventilation hood platform in the truck loading building.  The
employee was not protected from a fall hazard of approximately 13
feet while riding, exiting and entering the bucket at the
platform.  One method of abatement is to use a scissors lift or
other device designed to raise personnel to an elevated platform.
In accordance with 29 CFR 1903.19(d), abatement certification is
required for this violation (using the CERTIFICATION OF
CORRECTIVE ACTION WORKSHEET), and in addition, documentation
demonstrating that abatement is complete must be included with
your certification.  This documentation may include, but is not
limited to, evidence of the purchase or repair of the equipment,
photographic or video evidence of abatement, or other written
records.
