Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were likely to cause death or serious physical harm to employees in that: a) Blaze Construction, Inc., worksite, Turnpike Toll Station Number 151, North Ridgeville, Ohio: On or about March 14, 2006, during ground grading activities, the employer did not ensure that employees were kept out of the swing radius of the hydrualic excavator, serial number P00120X031423. Abatement Note: One feasible abatement method would be to follow the Association of Equipment Manufacturers instructions listed in their "Safety Manual for Operating and Maintenance Personnel" (copyright 1992) manual for hydraulic excavators, which states that employees should never be allowed to enter the swing pivot area of the excavator. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
