Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees, in that:
a.  On or about March 23, 2006 at 2 Kexon Drive, Pioneer, Ohio:  The
employer, operating
a Ultima II, class 4 light amplification to Stimulated Emission of
Radiation (LASER) for welding
operations, did not fully implement a laser safety program that included
the requirements of
American Natiuonal Standards Institute, ANSI Z136.1, such as but not
limited to, delegation of
authority and responsibility to a designated Laser Safety Officer (LSO)
for the purpose of
monitoring and enforcement of hazard evaluation and control; Incident
investigation including
reporting of alleged accidents and preparations of action plans for
prevention of incidents and
accidents; and appropriate medical surveillance including ocular
examinations.
One feasible method of compliance is to conform to the requirements of the
American National
Standards Institute Publication ANSI Z136.1-2000, Section 4.2, and
Appendix D Laser Safety
Officers, Section 6.1, and Appendix E, Medical surveillance requirements.
