Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were likely to cause death or serious physical harm to employees, in that:
the operators working
with the 1-ton Dayton electric hoist in the spray area were exposed to the
potential hazard of
being struck by materials carried by the crane if the material were to be
disengaged from the
hoist due to the hooks not having safety latches:
a) Kel-Mar, Inc. - Toledo, Ohio - On or about January 22, 2007, the
employer did not ensure
the hook for the underhung 115V electric Dayton 1000lb-GGS chain hoist in
the spraying area
was equipped with a safety latch.
Among other methods, one feasible and acceptable method to correct this
hazard is to ensure that
hook safety latches are installed, per ANSI B30.16-2003, Overhead Hoists
(Underhung).
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this violation
(using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in
addition, documentation demonstrating that abatement is complete must be
included with
your certification.  This documentation may include, but is not limited
to, evidence of the
purchase or repair of the equipment, photographic or video evidence of
abatement, or other
written records.

were exposed to the
potential hazard of being struck-by materials carried by the crane due to
the improper handling
of the load:
a) Kel-Mar, Inc. - Toledo, Ohio - On or about January 22, 2007, the
employer
failed to ensure
that the operator(s) of the pendant controlled underhung 115V electric
Dayton 1000lb-GGS chain
hoist were properly lowering the approximate 700lbs. bin bottoms, in that,
the piece was
lowered toward the operator posing a struck-by hazard should the material
disengage.
Among other methods, one feasible and acceptable method to correct this
hazard is to ensure that
the operator shall not lift or lower a load with a hoist until the
operator and all other personnel
are clear of the load, per ANSI B30.16-2003 Overhead Hoist (Underhung).
In accordance with 29 CFR 1903.19(d), abatement certification is required
