Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were likely to cause death or serious physical harm to employees, in that employees were exposed to pinch point hazards on an excavator: a. BCC Ohio Inc. State Route 23 Bridge # 2020 Carey, Ohio: On or about April 19, 2007 employees were exposed to pinch point hazards while installing bridge brackets from the bucket of the Hyundai Rolex 180 LC-3 excavator. One means of abatement is to follow the safe operating procedures set forth in Association of Equipment Manufactures Safety Manual for Hydraulic excavators, which states never use a bucket for a work platform or personnel carrier. No abatement certification or documentation is required for this item.
