furnish employment and a place of employment which was free from
recognized hazards that
were likely to cause death or serious physical harm to employees.
a.  On or about May 31, 2007, at the above addressed jobsite, a powered
industrial truck
operator had driven inside a semi-trailer for the purpose of unloading it
when the semi-trailer
driver pulled away from the dock causing the powered industrial truck and
the operator to fall
to the ground.
b.  On or about June 1, 2007, at the above addressed jobsite, a powered
industrial truck operator
entered a semi-trailer for the purpose of loading it when the semi-trailer
driver pulled away from
the dock causing the powered industrial truck and the operator to fall to
the ground.
Among other methods, one feasible and acceptable abatement method to
correct
this hazard is
to implement procedures for checking trailers of the semi-trucks prior to
releasing them and the
installation of dock locks to prevent the trailer from being moved.
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this violation
(using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in
addition, documentation demonstrating that abatement is complete must be
included with
your certification.  This documentation may include, but is not limited
to, evidence of the
purchase or repair of the equipment, photographic or video evidence of
abatement, or other
written records.
