Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an injury from not being restrained in a forklift in case of tipping and /or roll over. a)Marine Terminal Building at Pier 1: An employee was moving cargo using a Hyster Forklift, unit 355. The forklift was equipped with seatbelts which worked, however, the employee was not using the restraining device. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THE HAZARD IS TO WEAR THE SEATBELT AS REFERENCED IN ASME B56.1-2004, "SAFETY STANDARD FOR LOW LIFT AND HIGH LIFT TRUCKS"
