North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that seatbelts were not utilized by employees when operating rough terrain forklifts : a)jobsite, no seatbelt was utilized by the employee who was using the Gradall 534D rough terrain forklift to move "mud" for building the brick wall. Among other methods, one feasible and acceptable method to abate this hazard is to ensure that operators wear the seatbelt when operating any forklift.
