Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a)Crushing injuries in that on January 17, 2006, the 1991 Komatsu fork truck #12, Model FG25ST-11, S/N 301220-A, was operated without the use of the provided seat belt, on or about January 24, 2006. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS to train and enforce the use of the provided seat belts.
