Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of burns, smoke inhalation, and death from potential leakage and ignition of propane from a gas line outlet which was not capped or plugged gastight: a.429 Halycon Lane, Berkeley Springs, WV, Product Test Site, Kitchen Area - Employees perform work in the kitchen regularly which involves operation of propane powered stove/oven/grill (American Range). An unused gas line outlet adjacent to this stove/oven/grill was not capped or plugged gastight with a threaded plug or cap, per NFPA 54 requirements, as observed on 7-25-07. ABATEMENT NOTE: Feasible means of abatement for this hazard would be to install a cap or plug which is gastight to prevent propane gas from entering the work area through valve leakage or inadvertent opening of the valve.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of burns, smoke inhalation, and death due to malfunction of wet chemical fire suppression unit in ventilation hood due to lack of regular inspection and maintenance: a.429 Halycon Lane, Berkeley Springs, WV, Product Test Site, Kitchen Area - Employees perform work in the kitchen regularly involving operation of gas powered stove/oven/grill (American Range), which is provided with a ventilation hood (Dreaco Products, Inc.) with wet chemical fire suppression system (Range Guard, Model RG-2.5G). The employer did not ensure that the wet chemical fire suppresion system was provided with inspection and maintenance on a regular basis, per manufacturer and NFPA 17A requirements, as determined on 7-25-07. ABATEMENT NOTE: Feasible means of abatement for this hazard would be to inspect the unit on a monthly basis and provide for semiannual maintenance checks, as described by NFPA 17A requirements and by the manufacturer.
