Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries and/or amputation injuries while operating machinery without foot pedal/treadle guards: (a)Sheet Metal Shop. The Cincinnati hydraulic shear had a 10'5" foot treadle that was not guarded, on or about February 5, 2008. (b)Sheet Metal Shop. The ENCO pnuematic shear had a foot pedal that was not guarded, on or about February 5, 2008. Among other methods, one feasible and acceptable abatement method to correct this hazard is to protect/guard the foot pedal/treadle so as to prevent accidental actuation by falling or moving objects, or by someone accidentally stepping on them.
