Title 40.1-51.1.(a); Code of Virginia: At 8220 Birch Street, Manassas, VA,
20111, the employer did not
furnish employment and a place of employment which was free from
recognized hazards that were causing or
likely to cause death or serious physical harm to employees in that
employeess were exposed to crushing and
caught between hazards while operating a Toyota Forklift (Model number
42-6FG25-13719).
a.An employee operating a Toyota Forklift was not able to read all
nameplates, caution and instruction
markings placed on the vehicle provided by the manufacturer.  Among other
safety warnings that were
not legible was the following prohibition: "Lift trucks can tip over even
when empty.  Slow down for
turns, steer smoothly and slowly.  Always fasten the seat belt and stay
with the truck if it tips... Keep
forks low and tilted back." (Reference page 20 of Toyota Forklift Owner's
Manual).  The operator was
preparing to transport the forklift on a flatbed truck when the forklift
overturned
and crushed the
operator.  The investigation revealed that the victim was not wearing his
seat belt and was traveling
with the mast fully extended when it tipped over.
One feasible and acceptable abatement method, among others, to correct
this hazard is for the
employer to comply with the American Society of Mechanical Engineers /
American National
Standard for Low lift and High lift truck requirements  ASME/ANSI
B56.1c-1991 4.2.3 which
reads:  The user shall see that all name plates and caution and
instruction markings are in place
and legible.
[NOTE:  The Toyota Forklift Owner's Manual also provides the following on
page 19:
"Decals and plates that give you information about safe operation are on
your truck.  Study
them and if you have any questions, ask your supervisor.  Make sure they
stay on your truck in
clean, readable condition."]
