North Carolina General Statute 95-129(1) of the Occupational Safety and
Health Act of North Carolina:  The
employer did not furnish to each of his employees conditions of employment
and place of employment free
from recognized hazards that were causing or likely to cause death or
serious physical harm to employees, in
that employees were exposed to:
a)being struck by.  An employee of Triple T Enterprises of Thomasville,
Inc. passed below the
the load of the Sky Trak, serial # unknown, model # unknown, forklift
being used at the time
of this inspection to lift a Nations Rent scissor lift serial # unknown,
model # unknown with
two employees working on the platform of the scissor lift at a height of
10 feet installing
exterior metal siding.
b)fall from height.  Two employees were working on the platform of a
Nations Rent scissor lift
serial # unknown,  model # unknown, being lifted by  the Sky Trak, serial
# unknown, model #
unknown, forklift to a height of 10 feet installing  exterior metal
siding.
The scissor list was
not firmly secured to the forklift, nor was there any provision so that
the personnel in the
scissor lift could shut off power to the forklift.
c) fall from height. Without any information on the lift capacity of the
forklift or the weight of the
scissor lift being lifted.  Two employees were working on the platform of
a Nations Rent
scissor lift serial # unknown, model # unknown being lifted by the Sky
Trak, serial # unknown,
model # unknown, forklift at a height of 10 feet installing exterior metal
siding.
d)being caught between the forklift and the ground. An employee was
observed operating the
Sky Trak forklift, serial # unknown, model # unknown without the use of a
seatbelt, to lift a
NationsRent scissor lift serial # unknown, model # unknown with two
employees in it to a
height of 10 feet installing exterior metal siding.
ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement
method
to reduce this hazard would be to properly retrain all employees operating
and working around
forklifts to never work or walk under loads being lifted, and also retrain
in proper lifting
methods to include proper securing of load, obtaining rated load capacity
of the forklift and
matching it with the weight of the load being lifted,  and to install in
the lift with a means for
personnel to shut off power to the forklift, and install a seat belt to be
used by the operator
while operating the forklift.
