North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards associated with forklift operators not wearing or required to wear seatbelts: a)facility- Forklift operators were not required to wear seatbelts while operating the Nissan 50 LP forklift. ABATEMENT NOTE: Among other methods, one feasible method to reduce this hazard is to implement the requirement for wearing seatbelts while operating forklifts as a company policy, instruct the operators on the policy, and enforce the policy daily.
