North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by a falling load: a)Small tank department - the bridge crane used to lift and move the small tanks was equipped with an underhung lifting device that had a broken safety latch. The lifting device was not put out of service, once the defect in the latch was discovered, until the safety latch could be repaired. NOTE: Among others methods, one feasible and acceptable abatement method to correct this hazard is to repair the safety latch on the underhung lifting device.
