North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)facility, maintenance shop - the Yale 3-ton Jib crane used by maintenance employees had a hoisting hook with a deformed and damaged safety latch. One feasible and acceptable abatement method would be to repair the safety latch with a manufacturer supplied latching kit. Additionally, frequent inspections of the crane should be performed to ensure employees do not operate the crane with damaged or missing parts.g
