North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to falls in excess of 25 feet: a)jobsite- the employees working from and being lifted to the steel from the shop built basket were exposed to falling 28 feet to the compacted ground due to the basket not being secured properly to the forks or backrest of the forks. The basket was provided with pins at the rear of each fork to prevent it from coming off the forks but only the left pin was in place. Reference ANSI/SIA A92.2-1990. One reasonable and acceptable method of abatement would be to secure the basket to both forks of the lift vehicle using the pins as designed and attaching the pins to the basket with chains to prevent their being lost.
