North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: the hazards associated with entering a permit required confined space without properly testing the internal atmosphere before entry. a)jobsite - employees entered a buried water line valve vault without first testing for oxygen content or toxic air contaminants. One feasible and acceptable abatement method would be to test the atmosphere of the permit required confined space for oxygen content and toxic air contaminants using a calibrated direct reading instrument prior to entry and periodically during each entry.

One feasible and acceptable abatement method would be to have the employee guide the backhoe while standing out of the reach of the backhoe.
